What happened: On August 2026 Ghana’s Parliament enacted the Tribunals Bill (Tribunals Bill, 2026), restoring a statutory framework for specialised tribunals to decide administrative and regulatory disputes outside the ordinary courts. The legislation creates new tribunal structures, a Tribunal Oversight Committee, and provisions intended to streamline case management and appeal routes to superior courts.

Why it matters legally: The reintroduction of tribunals reshapes where many public-law and regulatory disputes will be heard. Tribunals can provide faster, specialist decisions on taxation, labour, land, immigration and regulatory matters. The Bill’s oversight and appeal provisions determine how tribunal decisions interact with the High Court and Court of Appeal — affecting judicial review, finality of administrative rulings and the separation of adjudicative functions between courts and quasi-judicial bodies.

Background: Tribunals historically played a role in Ghana but had become largely inactive. High court backlogs and delays in administrative dispute resolution prompted renewed legislative interest. Key legal questions include tribunals’ constitutional status, whether their decisions are subject to full judicial review, and safeguards for fair hearing and independence.

Consequences to watch: Litigation is likely on the Bill’s constitutional compatibility (particularly Article 125–144 questions about judicial power and access to court), the scope of tribunal jurisdiction, and how appeal pathways will operate in practice. Administrative bodies, regulated industries and access-to-justice advocates will all be directly affected.
